These Terms and Conditions of Sale govern the purchase of products offered on poppot.it by Pop Pot S.r.l. SB (“Pop Pot”, “we”, “us”, “our”). By placing an order through the Website, the customer (“Customer”, “you”) accepts these Terms and Conditions.

Please read them carefully before placing an order.

 

1. Seller Information

Pop Pot is a design brand specialising in digitally crafted, 3D-printed design objects, including vases, amphorae, lighting pieces and sculptural elements inspired by historical archetypes and contemporary digital manufacturing.

 

2. Scope of Application

These Terms and Conditions apply to all purchases made on the Website by consumers and, where applicable, by professional customers.

 

A “Consumer” is any natural person who purchases products for purposes unrelated to any business, commercial, craft or professional activity. A “Professional Customer” is any person or entity purchasing products for business, commercial, craft or professional purposes.

 

In the event of specific written agreements, quotations, trade terms, wholesale terms or project-based contracts agreed directly with Pop Pot, those specific terms shall prevail over these Terms and Conditions where expressly stated.

 

3. Products

Pop Pot products are digitally designed and manufactured using 3D-printing technologies. Many products are made to order and may be customised in terms of colour, size, finish, material or other specifications selected by the Customer.

 

The Website provides product descriptions, images, dimensions, colours, materials and other information as accurately as possible. However, minor variations may occur due to the digital manufacturing process, screen colour settings, material behaviour, manual finishing processes and the individual nature of each item.

 

Such variations are not considered defects where they do not materially affect the intended use, quality or identity of the product.

 

4. Materials and Use

Pop Pot products may be made from materials including, but not limited to, PLA, PETG and other bio-based or recyclable polymers.

 

Unless otherwise stated on the relevant product page:

  • PLA products are intended primarily for indoor use.
  • PLA is a thermosensitive material. PLA products must not be exposed to direct sunlight, prolonged sunlight, heat sources, radiators, fireplaces, hot surfaces, lamps generating excessive heat, high-temperature environments, cars exposed to the sun, or harsh outdoor conditions.
  • Heat and direct sunlight may cause deformation, softening, warping, colour alteration or other material changes. These effects are considered consequences of improper use and are not product defects.
  • PETG or other suitable materials may be recommended for products intended for outdoor use, high-sun exposure or spaces subject to stronger thermal stress.
  • Customers should contact Pop Pot before ordering if the product is intended for outdoor use, window displays, shopfronts, terraces, hospitality spaces, sunny interiors or any environment exposed to heat or direct sunlight.
  • Products are not intended for food contact unless expressly indicated.
  • Products are not toys and should be kept away from small children where breakage, instability or misuse could create risk.

 

The Customer is responsible for using the product in accordance with its intended purpose and with the care instructions provided by Pop Pot.

 

5. Orders

To place an order, the Customer must select the desired product, options and quantity, provide the requested billing and shipping information, choose a payment method and confirm the order.

 

Before submitting the order, the Customer is responsible for checking that all information provided is accurate, including product options, colours, dimensions, delivery address and contact details.

 

After the order is placed, the Customer will receive an order confirmation by email. This confirmation does not necessarily mean that the order has been accepted if there are errors, payment issues, product unavailability or other exceptional circumstances.

 

Pop Pot reserves the right to refuse, cancel or limit any order in cases including, but not limited to:

  • incorrect or incomplete customer information;
  • payment failure or suspected fraud;
  • product or material unavailability;
  • obvious pricing or technical errors on the Website;
  • orders that cannot be fulfilled due to production constraints;
  • orders intended for unlawful, unsafe or unauthorised resale purposes.

 

If an order is cancelled after payment has been received, Pop Pot will refund the amount paid using the same payment method, unless otherwise agreed.

 

6. Prices

All prices are displayed in euros (€), unless otherwise indicated.

 

Prices include VAT where applicable, unless expressly stated otherwise. Shipping costs, customs duties, import taxes or additional local charges may not be included in the product price and may be shown separately during checkout or charged by local authorities upon import.

 

Pop Pot reserves the right to change product prices at any time. The price charged to the Customer will be the price displayed at the time the order is placed, subject to correction of obvious errors.

 

7. Payment

Available payment methods are shown during checkout and may include, depending on availability, credit/debit card, bank transfer, PayPal, Stripe, or other payment providers.

 

Payment must be completed according to the instructions provided during checkout. For bank transfers, production and/or shipping may begin only after payment has been received.

 

The Customer guarantees that they are authorised to use the selected payment method.

Pop Pot does not store full payment card details. Payments may be processed by third-party payment providers according to their own terms and privacy policies.

 

8. Made-to-Order and Customised Products

Many Pop Pot products are made to order and/or customised according to the Customer’s specifications, including but not limited to colour, material, dimensions, finish, configuration or other personalised choices.

 

For made-to-order and customised products, production may begin after the order confirmation and payment. Once production has started, changes or cancellations may not be possible.

 

Where legally permitted, the right of withdrawal does not apply to products made to the Customer’s specifications or clearly personalised.

 

9. Production Times

Production times vary depending on the product, material, quantity, level of customisation and current production capacity.

 

Indicative production times may be displayed on the Website or communicated by Pop Pot. Unless otherwise stated, standard made-to-order products usually require from 5 to 14 working days before shipment, depending on the product, material, quantity and level of customisation. For large-size products, including columns, Giant vases, oversized pieces, bespoke products and B2B quantities, production may require up to 21 working days or a specifically agreed production schedule.

 

Production times are estimates and do not include shipping time. For B2B orders, large quantities, oversized products, custom projects or urgent deadlines, the Customer is required to contact Pop Pot before placing the order in order to define production timing, feasibility, shipping method and shipping costs. Delays may occur due to material availability, technical issues, quality control, high demand, courier delays or force majeure events.

 

Pop Pot will make reasonable efforts to inform the Customer of significant delays.

 

10. Shipping and Delivery

Products are shipped to the delivery address provided by the Customer during checkout.

 

Shipping options, estimated delivery times and shipping costs are shown during checkout where available or communicated separately for B2B orders, large quantities, oversized products, international deliveries, custom projects or installation-based projects. For these cases, the Customer must contact Pop Pot in advance to define timing, packaging, shipping method and shipping costs.

 

Delivery times are estimates and may vary depending on the destination, courier, customs procedures, local delivery conditions and other factors outside Pop Pot’s control.

 

The Customer is responsible for providing a complete and accurate delivery address, including postcode, recipient name, phone number and any access information required by the courier.

 

Pop Pot is not responsible for delays or failed deliveries caused by incorrect, incomplete or inaccessible delivery information provided by the Customer.

 

11. International Shipping, Customs and Import Duties

For deliveries outside Italy and/or outside the European Union, the Customer may be required to pay customs duties, import VAT, taxes, brokerage fees or other local charges.

 

These charges are not controlled by Pop Pot and are the responsibility of the Customer unless expressly stated otherwise in writing.

 

The Customer is responsible for complying with local import regulations applicable in the destination country.

 

12. Receipt of Products and Damaged Deliveries

Upon delivery, the Customer should inspect the packaging and products as soon as possible.

 

If the package appears visibly damaged, tampered with or compromised, the Customer should, where possible:

  • accept the delivery with written reservation or damage note to the courier;
  • take clear photographs of the external packaging before opening;
  • take photographs of the damaged product and internal packaging;
  • contact Pop Pot promptly at info@poppot.it.

 

Claims for products damaged during transport should be reported within 48 hours from delivery, together with photographic evidence and the order number.

 

Failure to report damage promptly may affect Pop Pot’s ability to open a courier claim or provide a remedy.

 

13. Right of Withdrawal for Consumers

If the Customer is a Consumer and purchases a non-customised product online, the Customer may have the right to withdraw from the contract within 14 days of receiving the product, without giving any reason.

 

To exercise the right of withdrawal, the Customer must inform Pop Pot by email at info@poppot.it within the withdrawal period, clearly stating the intention to withdraw from the purchase and providing the order number.

 

The product must be returned in its original condition, unused, undamaged and, where possible, in its original packaging.

 

Unless otherwise required by applicable law or expressly agreed by Pop Pot in writing, return shipping costs are borne by the Customer.

 

After receiving and inspecting the returned product, Pop Pot will refund the eligible amount using the same payment method used for the original purchase, unless otherwise agreed.

 

14. Exclusion of Withdrawal for Customised or Made-to-Order Products

The right of withdrawal does not apply to products made to the Customer’s specifications or clearly personalised, including products manufactured in colours, dimensions, materials, configurations, finishes or variants selected specifically by the Customer.

 

Because many Pop Pot products are made to order or customised, the Customer is invited to carefully check all product options before confirming the order.

 

This exclusion does not affect the Customer’s rights in the event of defective or non-conforming products under applicable consumer protection law.

 

15. Returns

Returns must be authorised in advance by Pop Pot. The Customer should contact info@poppot.it before sending any product back.

 

Products returned without prior notice or authorisation may not be accepted.

 

The Customer is responsible for securely packaging the product for return shipment. Pop Pot is not responsible for damage caused by inadequate return packaging.

16. Defective or Non-Conforming Products

If a product is defective or does not conform to the order, the Customer should contact Pop Pot at info@poppot.it, providing the order number, a description of the issue and photographic evidence where relevant.

 

Where the defect or non-conformity is confirmed, Pop Pot will provide the remedies required by applicable law, which may include repair, replacement, price reduction or refund, depending on the circumstances and legal requirements.

 

Minor variations in colour, texture, layering, surface appearance, print lines, dimensions within reasonable tolerances or other characteristics inherent to 3D printing and digital craftsmanship are not considered defects unless they materially affect the product’s quality, use or agreed specifications.

 

17. Warranty

Consumer purchases are covered by the legal guarantee of conformity provided by applicable consumer law.

 

The warranty does not cover damage caused by:

  • improper use;
  • accidental damage;
  • exposure to unsuitable environmental conditions;
  • exposure of PLA products to direct sunlight, prolonged sunlight, heat sources, high temperatures or outdoor conditions;
  • prolonged direct sunlight or excessive heat where not compatible with the selected material;
  • impact, falls, mishandling or poor maintenance;
  • modifications or repairs carried out by third parties;
  • normal wear and tear;
  • failure to follow care instructions.

 

For Professional Customers, warranties may be limited to the extent permitted by applicable law and/or governed by specific written agreements.

 

18. Product Care

Products should be handled with care. Unless otherwise stated, Pop Pot recommends:

  • cleaning with a soft, dry or slightly damp cloth;
  • avoiding abrasive cleaners, solvents, alcohol-based products or aggressive chemicals;
  • avoiding exposure to direct sunlight, especially for PLA products;
  • keeping products away from radiators, fireplaces, hot surfaces, lamps generating excessive heat, heated floors, cars exposed to the sun and any other strong heat source;
  • using appropriate supports or installation methods for large or lighting products.

 

Additional care instructions may be provided on product pages, packaging or by email.

 

19. Lighting Products and Electrical Components

Where products include lighting elements, LEDs, cables, power supplies, dimmers or other electrical components, the Customer must use them only as instructed and with compatible components.

 

Electrical components must not be modified, opened, rewired or used with non-compatible power supplies unless expressly authorised by Pop Pot.

 

Lighting products, prototypes or bespoke lighting projects may be subject to specific technical, regulatory, installation or usage conditions, which will be communicated or agreed separately where applicable.

 

20. Intellectual Property

All content on the Website, including product designs, images, photographs, text, graphics, logos, trademarks, product names, 3D models, digital files, renderings, configurations and design concepts, is owned by or licensed to Pop Pot and is protected by intellectual property laws.

 

Purchasing a product does not transfer any intellectual property rights to the Customer.

 

The Customer may not copy, reproduce, modify, reverse-engineer, scan, 3D-print, distribute, sell, commercially exploit or create derivative works based on Pop Pot products, designs, digital models or content without Pop Pot’s prior written consent.

 

21. Website Use

The Customer agrees to use the Website lawfully and not to interfere with its proper functioning.

 

The Customer must not:

  • misuse the Website;
  • attempt unauthorised access;
  • introduce malware or harmful code;
  • copy or scrape Website content for commercial use;
  • use the Website in a way that may damage Pop Pot or third parties.

 

Pop Pot may suspend or restrict access to the Website in case of misuse or technical/security issues.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Pop Pot is not liable for indirect, incidental, consequential or punitive damages, loss of profit, loss of business opportunity, or losses resulting from improper use of products.

 

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability for death or personal injury caused by negligence, fraud, or mandatory consumer rights.

 

23. Force Majeure

Pop Pot shall not be liable for delays or failure to perform obligations caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, transport disruptions, supply-chain issues, material shortages, energy interruptions, cyber incidents, governmental measures, customs delays, war, pandemics or other force majeure events.

 

24. Privacy

Personal data provided by the Customer is processed in accordance with Pop Pot’s Privacy Policy, available at: Privacy Policy.

 

Cookie-related information is available in the Cookie Policy.

 

Additional company and legal information is available at: Art. 25 DL 179/2012.

 

The Customer is invited to read the Privacy Policy before placing an order.

 

25. Communications

26. Governing Law

These Terms and Conditions are governed by Italian law.

 

If the Customer is a Consumer resident in another country, they may also benefit from the mandatory consumer protection provisions of their country of residence, where applicable.

 

27. Disputes and Jurisdiction

For Consumer Customers, disputes shall be submitted to the competent court according to applicable consumer law, generally the court of the Consumer’s place of residence or domicile where required by mandatory law.

 

For Professional Customers, unless otherwise required by mandatory law or agreed in writing, the competent court shall be Rome, Italy.

 

Consumers may also have access to alternative dispute resolution mechanisms where available under applicable law.

 

28. Changes to These Terms

Pop Pot may update or modify these Terms and Conditions from time to time.

 

The Terms and Conditions applicable to an order are those in force at the time the order is placed.

 

Customers are encouraged to review this page periodically.
